Thailand Divorce Agreement
If you have really come to a point in your marriage where you want to get a divorce, there are a few things to know about the Thailand Divorce Agreement. If both parties agree on all aspects of the separation, making a divorce agreement and divorcing by consent will save you money and time. In this package, we are offering you a binding contract between two spouses that will determine issues concerning shared property, child custody, visitation rights, and other marital issues that must be settled before the divorce is granted.
This Thailand Divorce Agreement may also include provisions for spousal support or alimony as well as child support. The parties may negotiate an agreement rather than pursue a court divorce which is normally more expensive. Our Divorce Agreement is – a material representation of the spouses’ arrangements on the rights and privileges they will enjoy once the divorce is granted. It was drafted by Thai attorneys having experience in Family Law.
This contract must be signed by the parties and also two witnesses (adults, 20 yo and older), then registered at the Amphur (the local municipality office). Remember that the Amphur does not provide documents in English so having a divorce agreement prepared in advance, bilingual and showing your intentions can really help you.
Thai court will consider what is provided in the Thailand Divorce Agreement as reflecting the intent and covenant of the parties and will normally deliver a judgment that approves the divorce agreement. However, on certain issues, one party may allege a breach of the settlement or a “change of circumstances” that might lead to a modification of the Agreement.
